UFC 312 PPV Code Giveaway Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

Sponsor:  True Classic Tees, LLC., a California limited liability corporation with its principal place of business at 26635 Agoura Rd Ste 105 Calabasas, CA, 91302-3807.

By participating, you (“entrant” or “you”) agree to these Official Rules and to the decisions of Sponsor, which decisions are final and binding in all respects.  

1. Contest Period and Eligibility: The UFC 312 PPV Giveaway (the “Contest”) starts on February 5th at 12:00:00 a.m. Pacific Time (PT) and ends on February 8, 2024 at 03:59:59 p.m. PT (the “Contest Period”). The Contest is open to legal residents of the 50 United States and the District of Columbia who are age 18 or older at the time of entry. Void elsewhere and where prohibited by law.  Employees, officers, and directors of Sponsor and its subsidiaries, affiliates, and agencies (collectively, the “Contest Entities”), and immediate family members (defined as spouse, siblings, children, step-children, parents) of such individuals are not eligible to participate. The Contest is subject to all applicable federal, state, and local laws. 

How to Enter: Internet access and Instagram account required to enter the Sweepstakes, entrant (“Entrant”) must be a registered member of Instagram.

STEP 1: Log into your Instagram account via a web-enabled mobile device (if you are not already a member of Instagram, download and install the free Instagram mobile application on your web-enabled mobile device and register for a free Instagram account). Your Account must be a Public Account.

STEP 2: Sponsor will post on or about February 5, 2025 at approximately 1:00 PM EST on the @trueclassic  Instagram page.

STEP 3: During the Sweepstakes Period, Entrant must (1) “Tag” the Post post with 3 friends in the comments, (2) follow @trueclassicon Instagram, and (3) Share the Post to their Instagram stories and tag @trueclassic  Only one (1) entry per Instagram account.

By participating in this Sweepstakes, each Entrant hereby warrants and represents that his/her Entry and any materials associated with his/her Entry ("Entry Materials"):

• Are original to him/her and/or that the entrant has obtained all necessary rights in and to the Entry Materials for the purposes of submitting such Entry Materials in this Sweepstakes;

• Do not violate any law, statute, ordinance or regulation;

• Do not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;

• Do not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;

• Will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and

• Are not defamatory, trade libelous, pornographic or obscene, and further that such Entry Materials will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behavior or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor (e.g. any clothing worn and/or products appearing in your Entry Materials must not contain any visible logos, trade-marks or other third party materials unless the appropriate consents have been obtained; conduct or other activities in violation of these rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by Sponsor in its sole discretion

Sponsor is not responsible for late, unsent, inaccurate, or incomplete Entries, regardless of cause, including without limitation, due to human or technical error, whether caused by the entrant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical or human error that may occur in the transmittal of any Entry or the processing of any function on the entrant’s computer system.  Entrants must notify Sponsor of any changed contact information within the Entry Period to remain eligible to win based on an Entry.  Any eligibility disputes will be determined by Sponsor in its sole discretion.  

Sponsor reserves the right, in its sole discretion, to disqualify any individual or entity found to be tampering with the Entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules or applicable laws; or to be acting with intent to annoy, abuse, threaten or harass any third party.  Any use of robotic, automatic, programmed or similar entry methods is prohibited and any such Entries will be disqualified and void.

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. Instagram is hereby completely released of all liability by each participant in this Sweepstakes.  Any questions, comments or complaints regarding this Sweepstakes must be directed to Sponsor and not to Instagram.

2. ALTERNATE MEANS OF ENTRY:  Should you wish to enter without utilizing Instagram, you may do so by hand-printing your name, address, phone number, age and, the name of the campaign “UFC 312 PPV Code Giveaway” if available, e-mail address on a 3" x 5" paper and mailing it to: 26635 Agoura Rd Ste 105 Calabasas, CA, 91302-3807 (this method of entry is referred to herein as the "Alternate Entry Method"). 

3. Winner Selection and Notification: At the conclusion of the Contest Period, a winner will be selected at random by Sponsor. Sponsor will notify the potential winner via direct message Instagram and the potential winner must respond to the notification and provide his/her email address to Sponsor within five business days. If the winning Entry is discovered to be invalid for any reason prior to delivery of the Prize, or if the Winner cannot be contacted or does not respond within five (5) business days, an alternate winner may be selected, at the sole discretion of the Sponsor. If there is no winner by the 30th day after end of Sweepstakes, no further winners will be chosen.

Before being declared the official winner, the potential winner will be required to execute and email to Sponsor an Affidavit of Eligibility/Liability & Publicity Release no later than five business days after the time such form is emailed to the potential winner. If the potential winner cannot be contacted, fails to respond to Sponsor’s Instagram notification or return the executed Affidavit of Eligibility/Liability & Publicity Release within the timeframe above, or is found to be ineligible or not in compliance with these Official Rules, such potential winner will be disqualified and his/her prize forfeited, and the entrant with the photo that received the next highest score will be declared the potential winner, subject to the same notification process described above. For the name of the winner, send a self-addressed, postage-stamped envelope to: True Classics Tees, LLC c/o 365 Pack Giveaway, 26635 Agoura Rd Ste 105 Calabasas, CA, 91302-3807, within three months after conclusion of the Contest Period. 

The odds of winning will depend on the number of eligible Entries received during the Entry Period.

4. Prize: The following “Prize” is being awarded in this Sweepstakes: Six (6) winners will receive a 1 ESPN+ PPV code for UFC 312 (approximate retail value $79.99). All results and decisions are final and binding in all respects. The prize is awarded “as is” with no warranty or guarantee, either express or implied. The winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided.  Where applicable, taxes may be withheld by Sponsor and Sponsor shall have no obligation to adjust the prize or otherwise compensate the winner for any taxes withheld.  The winner agrees to furnish Sponsor with and/or execute any additional document requested by Sponsor in connection with the awarding of the prize. Prize is subject to applicable terms and conditions.

5. Conditions of Entry and General Terms:  As a condition of entering the Contest, entrant agrees: (i) to release, indemnify, and hold harmless the Contest Entities and Instagram any and all liability, loss, or damage incurred with respect to participating in the Contest or the awarding, receipt, possession, and/or use or misuse of a prize; (ii) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, any punitive, indirect, incidental, consequential, exemplary, or any other damages, other than for actual out-of-pocket expenses, and in no event will entrant be entitled to receive attorneys’ fees or court costs; and (iii) all causes of action arising out of or connected with the Contest or the awarded prizes shall be resolved individually, without resort to any form of class action. Contest Entities are not responsible for any problems of any kind relating to or in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature. These Official Rules shall be governed by the laws of the State of California, without regard to conflicts of law principles. All suits or claims brought in connection with this Contest must be brought in a state or federal court located in the State of California, and all entrants consent to jurisdiction and venue of the state and federal courts located in the State of California. In the event of any conflict with any Contest details contained in these Official Rules and Contest details contained in Contest-related materials, these Official Rules shall prevail. ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF LAW.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL, TO THE FULLEST EXTENT PERMITTED BY LAW.

6. By entering and participating in the Sweepstakes, you agree to be bound by these Rules and by Sponsor’s decisions, which are final and binding on all matters relating to the Sweepstakes. Entrants are required to provide accurate, valid and truthful information at all times. Sponsor is not responsible for electronic transmission errors, which result in the omission, interruption, deletion, defect, destruction, alteration, and/or delay of any Entry. Sponsor is not responsible for any technical, network, electronic, computer, hardware and/or software malfunction, problem, incompatibility, congestion or failure of any kind. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes at any time, in its sole discretion, if the Sweepstakes is not capable of completion as planned, including without limitation, the lack of Entry submissions, incomplete Entries, computer viruses, bugs, tampering, unauthorized intervention or technical failures of any sort, without notice. Upon cancellation or termination of the Sweepstakes for any reason, Sponsor shall have no obligation to award prizes or compensation of any kind. ESPN+ PPV Code is valid only for U.S. residents, 16 years of age or older. Code entitles the holder to the UFC 312 PPV Event on ESPN+, which will be credited to your ESPN account upon redemption. To redeem, visit ESPNPlus.com/redeem, enter the code printed above, and create or log into your ESPN account. A condition to redemption is that holder must accept our Subscriber Agreement in connection with their access to ESPN+. PPV Code is one-time use only. Void where prohibited, not a gift card. Cannot be combined with any other offers, coupons, discounts or promotions. PPV Code is not refundable or redeemable for cash or any other goods or services and cannot be sold, or exchanged or credited towards purchase of other subscriptions, and will not be honored if obtained from any third party. This promotion is in no way sponsored by, endorsed by, administered by, or associated with META, ESPN, or UFC. ESPN and its affiliates are released from any claims.

By entering the Sweepstakes, or providing your information to us, you agree to accept the uses of your information described in this privacy policy.
